The government removed a number of wartime procurement restrictions
The Government of Ukraine adopted a resolution on the specifics of conducting public procurement during martial law. From now on, purchases can be made in the Prozorro system according to a new procedure.
From now on, tenders in Prozorro can be conducted with an offer from one participant – this should increase the number of successful results in the electronic system, while leaving the opportunity for open competition in the auction. In addition, the procedure envisages shortening the terms of conducting full-fledged tenders in Prozorro – twice as fast as before.
At the same time, conducting open tenders according to the new procedure provides an opportunity for suppliers to challenge the terms and results of the tender at the Antimonopoly Commission.
The resolution takes into account the peculiarities and limitations of procurement during martial law. Yes, there remains a large list of reasons for concluding direct contracts for urgent and defense needs: in this case, it will be enough to report on the concluded contract (from UAH 50,000) in the Prozorro system. Sensitive information about the place of delivery or the location of the customer and supplier can be hidden. A ban on the purchase of goods and services with suppliers associated with russia and Belarus is also approved.
