The Ministry of Development explained how the concession at the port of Chornomorsk will take place

The Ministry of Development explained why the terminals at the port of Chornomorsk will be given for concession without using the Prozorro system.
This was reported by the Ministry for Development of Communities and Territories of Ukraine.
The Cabinet of Ministers updated Resolution No. 909 of August 20, 2021, which determines the rules for conducting a competition for selecting an investor in public-private partnership projects. This is the first step to bring all government documents into line with the new Law “On Public-Private Partnership”, which entered into force on October 31, 2025.
The new Law provides that all competitions and competitive dialogue procedures must be conducted exclusively through the Prozorro electronic system from January 1, 2027. Therefore, the update of Resolution No. 909 is a technical change that adjusts the rules to these requirements.
“The Law also obliges the Government and ministries to update all by-laws within a year. There are more than 30 such documents, so without their adaptation, the full implementation of the Law is impossible. International partners — EBRD, IFC and the World Bank — are involved in the preparation of these acts. They provide the Ministry of Development and the Ministry of Economy with expert and technical support,” the ministry notes.
The first public-private partnership project being prepared by the Ministry of Development concerns a container terminal in the port of Chornomorsk. It will be conducted using a competitive dialogue procedure consisting of two stages: prequalification and selection of the best offer.
• Prequalification is to ensure that only investors with proven experience in managing large-scale infrastructure facilities and sufficient financial capacity are allowed to participate in the competition. Companies that are under sanctions, registered in offshore jurisdictions, are in bankruptcy proceedings or are associated with an aggressor country will not be able to participate in the competition.
• Then, the decision on the selection of the best offer will be made by the tender commission with the participation of representatives of the relevant ministries, the local community of Chornomorsk and trade unions.
The EBRD and IFC have already attracted leading international advisors who are helping to prepare the tender documentation.
The Ministry of Development emphasized that so far Prozorro and Prozorro.Sale do not have the necessary functionality to conduct tenders under the new Law. The development of this technical solution and the launch of an electronic trading system for such tenders should be completed within the next 12 months.
As previously reported by USM, the concession project includes the First and Container Terminals of the Chornomorsk port with six deep-water berths and all infrastructure.
