The court accepted the appeal of the reorganization of the seamen’s certification system.

The Odesa District Administrative Court accepted a renewed lawsuit against the Shipping Administration. The claimant requests the return of certification of seafarers through the Inspectorate for Training and Certification of Seafarers (IPDM) using the VRF ITCS service. The relevant court decision was published on “Opendatabot”.

According to the requirements, the Shipping Administration must send a notification to the IMO that the VRF ITCS service must be used to verify seafarers’ documents electronically.

The plaintiff also calls on the Shipping Administration to cancel the use of the “Sailor’s Cabinet” and to ensure the preservation of personal data contained in the State Register of Seamen’s Documents.

As explained by the head of the Shipping Administration Yevhenii Ignatenko, the court’s decision means that the plaintiff has changed the requirements and asked the court to accept them for consideration. In the future, the case will be considered taking it into account.

According to Ignatenko, representatives of the Shipping Administration are taking all necessary measures within their powers to ensure that the decision in the court case is legal and justified.

It will be recalled that the IPDM was marked by an extremely high level of corruption. The state qualification commission was accused of being biased and creating artificial obstacles in passing the exam for sailors. So, in January 2021, one of the specialists managed to challenge the results of the DCC exam in court, but such cases are exceptions.

At the same time, the “Sailor’s Cabinet” is also criticized, because it is not regulated by any legal act.

The results of the review of the case will be known at the next meeting. As long as there is no relevant legislation, the issue of certification of seafarers will continue to be in a state of uncertainty.
