The Prosecutor General’s Office denied information about the lifting of the arrest from the Borivazh terminal

The Borivazh terminal in the port of Pivdenny is still under arrest, and the issue of its transfer to ARMA is under judicial review.
This was reported by the Prosecutor General’s Office of Ukraine.
“A number of Telegram channels, referring to a post by one of the entrepreneurs, spread unverified and unreliable information that the Borivazh port was allegedly returned to its owners,” the message says.
The Prosecutor General’s Office recalled that in 2016, officials of Borivazh LLC, acting in prior collusion with officials of Agroterminal Logistics LLC, PJSC CB PrivatBank and other unidentified persons, committed illegal actions against pledged property – a marine grain cargo transshipment and storage complex, which was pledged to the National Bank of Ukraine under a mortgage agreement.
As part of the investigation of criminal proceedings, the Shevchenkivskyi District Court of Kyiv on February 21, 2025 imposed an arrest on the terminal, prohibiting its alienation and disposal. This decision is still in effect today.
In particular, on March 6, 2025, the court re-imposed an arrest with a ban on using the port and transferring it to the management of ARMA.
At the same time, on October 31, 2025, the court granted the petition of the representative of Terminal Borivazh LLC and canceled the arrest in terms of the ban on use and transfer to ARMA. At the same time, the decision of February 21, 2025 on the arrest and prohibition of alienation remained in force.
The department emphasized that on November 4 of this year, the prosecutor filed an appeal against the ruling of October 31.
“The materials have not yet been received by the Kyiv Court of Appeal, there is no notification of the date of consideration. In parallel, on November 6, 2025, a motion to seize property and transfer the port to ARMA was re-filed to the Shevchenkivskyi District Court. A hearing was scheduled for Wednesday, November 12, but the judge, for unknown reasons, withdrew the motion from consideration. A new date and time for the trial have not been set at this time,” the Prosecutor General’s Office noted.
Recall that in March 2025, the Borivazh terminal was seized and transferred to the National Agency for Identification, Tracing and Asset Management (ARMA).
