The reorganization of the Inspectorate for Certification of Seafarers was challenged again in court


In Ukraine, a lawsuit against the reorganization of the Inspectorate for Training and Certification of Seafarers was again registered.

The lawsuit was filed against the Shipping Administration and the Cabinet of Ministers of Ukraine. This was announced by the head of the Shipping Administration Yevhen Ignatenko.

“We are not surprised by such a lawsuit, because it is the resistance of those who are not interested in a transparent graduation process, and whose plans these changes disrupt,” Ignatenko wrote on Facebook.

We will remind you that on December 23, 2020, the scandalous District Administrative Court of the city of Kyiv suspended the liquidation of the Inspetorate and the transfer of its functions to the Shipping Administration. The decision was made as security for the claim of a member of the State Qualification Commission, a long-distance sailing captain, to the Cabinet of Ministers and the Ministry of Infrastructure.

The Ministry of Infrastructure tried to appeal the decision in the appeals court. But on March 9, 2021, the Sixth Court of Appeals upheld the decision of the District Administrative Court. The inspectorate continued to perform its functions.

According to Ignatenko, the lawsuit was filed by the same person who initiated legal proceedings two years ago with an identical composition of participants.

“I assure you that this administrative dispute will be resolved by the Shipping Administration in accordance with the procedural legislation, as there are no legal prerequisites for its satisfaction,” said the head of the Shipping Administration.

The inspectorate for the training and certification of seafarers is known for its extremely high level of corruption among maritime workers. The state qualification commission is often biased and makes it impossible for a seafarer to pass the exam. In January 2021, one of the specialists managed to challenge the results of the DCC exam in court, but such cases are an exception to the rules.

The sailors complain about the lack of communication with the Inspectorate, the indefinite period of verification of documents and the lack of explanations in case of rejection of applications. The “Sailor’s Cabinet” is also criticized, which was created as if to make the process of submitting documents transparent, but is not regulated by one or another legal act.
