Ukraine is preparing to terminate the agreement on the presence of the russian Black Sea Fleet in Crimea


Ukrainian deputies ask the court to verify the constitutionality of the “Kharkiv agreements” between Ukraine and russian federation.

On March 31, the Constitutional Court received a submission regarding the conformity of the Agreement between russian federation and the Ukraine regarding the presence of the occupying Black Sea Fleet on the territory of Ukraine with the Constitution of Ukraine, according to the court’s Telegram message.

The constitutional submission was signed by 49 people’s deputies. The agreement of April 21, 2010 was ratified by the Law of Ukraine of April 27, 2010, during the time of Viktor Yanukovych’s government. It was the “Kharkiv Agreements” that allowed the russian Black Sea Fleet to stay in Sevastopol until 2042, which contributed to the occupation of Crimea.

Deputies believe that the contested Agreement does not comply with Part 7 of Art. 17 of the Basic Law of Ukraine (the location of foreign military bases is not allowed on the territory of Ukraine). The deputies also claim that the specified agreement contradicts the principles of guaranteeing national security.

In addition, the People’s Deputies point out that the regulatory and legal framework for the conclusion of an international agreement of this content is tangible. And therefore, there are grounds for declaring the agreement unconstitutional.
