The court stopped the certification of Ukrainian seamen: what is known
The Shipping Administration is forced to temporarily stop the certification of Ukrainian sailors. This is the decision made by the court, currently the Administration plans to file an appeal.
According to the decision of the Kyiv District Administrative Court in case No. 320/17353/23, the Shipping Administration should stop the process of certifying sailors. Also, the court actually banned related activities, reports the Ministry of Infrastructure of Ukraine. f Ukraine.
“Our team has been fighting for a transparent and understandable system of certification of seafarers for more than a month. This struggle runs into desperate resistance from those who have been building corruption schemes on sailors for many years,” says Minister of Infrastructure Oleksandr Kubrakov.
The head of the Shipping Administration, Yevhen Ignatenko, stated that the state body was banned in accordance with the court decision.
“One decision of the odious judge of the Kyiv District Administrative Court Andrii Balaklytskyi can paralyze the activity of an entire state body and stop the process of certifying sailors. Even in wartime, representatives of Themis, contrary to the canons of justice, make decisions that contradict not only legislation, but also common sense,” Yevhenii Ignatenko notes.
The department reminded that last year the government adopted Resolution No. 1499. The document provides a transparent graduation mechanism and makes the legislation consistent with international conventions.
Since then, the Shipping Administration has received 31 lawsuits from various former members of the DCC (State Qualification Commission) of the Inspectorate for the Training and Certification of Seafarers, which was liquidated by resolution as an ineffective body.
“In all the lawsuits, the only goal is to prohibit the Shipping Administration from rebuilding the system, return the corruption link by blocking Government Resolution #1499, and continue to make money from seafarers. The team went through several court cases, 12 lawsuits were left without consideration. But there was a judge who called into question the graduation reform. This is a judge of the Kyiv District Administrative Court, who was removed from justice many times for violating the rules of procedural law and making illegal decisions in favor of third parties,” says Oleksandr Kubrakov’s comment.

It is interesting that the plaintiff in the case, due to which the Administration is forced to temporarily stop work, is a former member of the DCC.
“He emphasizes that he is a sailor by profession, holds the title of long-distance sailing captain and is an active member of the State Qualification Commission, whose work was organized by the Inspectorate for Training and Certification of Sailors,” adds Yevgen Ignatenko.
In the future, the Shipping Administration plans to file an appeal to challenge the court decision in court.
