AMCU fines companies over UAH 9 million for collusion in tenders for seaports

Three companies were fined for anti-competitive and concerted actions during participation in procurements for the state seaports of Reni and Izmail.

This was reported by the Antimonopoly Committee of Ukraine.

On Thursday, June 18, the Antimonopoly Committee of Ukraine adopted a decision recognizing that LLC KranTechElectro and LLC PORT I FLOT committed a conspiracy during participation in the tender for the repair of portal cranes for the SE “Reni Sea Commercial Port”. The procurement was carried out in 2022, and its expected cost exceeded UAH 20 million.

The Committee also established that LLC KranTechElectro and LLC TechMorPostach committed a conspiracy during the procurement of goods for the SE “Izmail Sea Commercial Port” in 2023. The expected cost of the tender was over UAH 15 million.

“The Committee established circumstances indicating that the companies committed anti-competitive concerted actions: coordinated behavior of the companies, communication between them and exchange of information during participation in the tenders,” the AMCU noted.

The companies’ actions were recognized as a violation of the legislation on the protection of economic competition. For this, the companies were fined a total of UAH 9.07 million.

The AMCU also recalled that companies that have been held liable for distorting tender results over the past three years may be denied participation in subsequent procurements.
