Double tonnage tax: Nibulon filed a complaint against the Mykolaiv branch of the USPA


The Antimonopoly Committee opened a case against the Mykolaiv Port Authority due to additional tonnage taxes.

Yesterday, on November 18th, the anti-monopoly authorities began consideration of the case on violation of the law on economic competition by the Mykolaiv branch of the State Enterprise “USPA”. The reason was the appeal to the AMCU from the company JV Nibulon LLC and marine agents. The parties declare that the Mykolaiv branch of the USPA unreasonably collects tonnage taxes from vessels that transship grain cargo on the territory of the sea terminal of JV Nibulon LLC. This was reported by the press service of the Antimonopoly Committee.

The investigation revealed that the vessels that go to the terminal of JV Nibulon LLC in transit through the water area of ​​the seaport of Mykolaiv pay the tonnage taxes twice. First, to the Mykolaiv branch of the State Enterprise “USPA” – for the transit passage of the water area, and then to Nibulon – according to the order of MIU №316 on port dues, as the owner of the operating water area.   Double collection of the tonnage taxes leads to an increase in the freight rate, which increases the final cost of the cargo for the consignee.

The Antimonopoly Committee believes that such actions violate the law on the protection of economic competition through anti-competitive actions by the administrative and economic management body.
