Ukraine has updated criticality criteria for agricultural enterprises: details


Criticality criteria for submission through the State Agrarian Register have been updated for Ukrainian agrarian enterprises.

This was reported by the All-Ukrainian Agrarian Council.

On June 24, 2026, the Ministry of Economy approved Order No. 6954 “Criteria for Determining Enterprises, Institutions and Organizations of Importance for Industries of the National Economy”. The document defines the criteria for confirming the status of enterprises as critical for the functioning of the economy. The Order came into force on June 24, 2026.

From this date, enterprises that meet the specified criteria can submit a package of documents through the state electronic system DAR.

According to Order No. 6954, separate criteria have been approved for enterprises of importance for the national economy in the field of agriculture. At the same time, according to Resolution No. 76, an enterprise must meet at least three criteria, two of which are mandatory.

The first mandatory criterion is the absence of arrears in taxes to the state and local budgets and the unified social contribution.

The second mandatory criterion is the amount of the accrued average salary of insured employees at a private enterprise for the last tax period, i.e. a month. It must not be lower than the minimum wage in the country multiplied by a factor of 3. This is confirmed by a certificate provided by the enterprise.

For enterprises located and actually operating in the territories of possible hostilities, active hostilities or in the territories of Ukraine temporarily occupied by the Russian Federation, for which List No. 376 does not specify the date of cessation of the possibility of hostilities, the date of completion of hostilities or temporary occupation, the monthly salary during the deferral period must not be lower than the minimum wage in the country multiplied by a factor of 2.5.

The third criterion is that the enterprise is of significant importance for the sector of the national economy.

In accordance with paragraph 4 of Order No. 6954, separate industry criteria have been defined for enterprises in the agricultural sector. One of them concerns the scale of the enterprise’s activities. In particular, the enterprise must meet one of the following indicators:

• cultivate agricultural land on an area of ​​at least 1,000 hectares for agricultural activities;

• cultivate perennial plantations on an area of ​​at least 50 hectares for the production of fruit products that are on the enterprise’s balance sheet;

• have an annual income, i.e. net income from the sale of products, goods, works or services, of at least 40 million UAH.

Another criterion concerns the type of activity of the enterprise. The enterprise must carry out one of the specified areas of activity:

• production, processing and sale, including export, of agricultural products;

• production and/or supply of plant protection products, including pesticides, seeds and/or planting material, veterinary drugs, fertilizers, agricultural machinery, equipment, equipment and spare parts for them;

• ensuring production and technological processes for receiving, cleaning, drying, storing, processing grain, oilseed and leguminous crops, as well as their products;

• scientific and technical activities aimed at creating conditions for increasing the efficiency of agricultural production and the level of food security of Ukraine;

• activities to provide partial guarantees for credit obligations of small and medium-sized businesses operating in the agricultural sector.

Separately, the order provides for a criterion for enterprises 100% of the shares or shares in the authorized capital of which belong to the state. These are enterprises formed by transforming a state enterprise and carrying out activities related to the sublease of state-owned agricultural land plots at land auctions.

Such a criterion is confirmed by an extract from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations, formed in accordance with the procedure established by the law on state registration, as well as a certificate of activity signed by the head of the enterprise. The certificate must indicate the number of land auctions conducted for the sublease of state-owned agricultural land plots, the number of concluded land sublease agreements, the total area of ​​land plots and the amount of sublease payments received.

To make a decision on determining an enterprise as being of importance to the national economy in the field of agriculture, a certified copy of the Tax Calculation for the last reporting period must be submitted with confirmation from the supervisory authority of the acceptance of this Tax Calculation.
