Criminal liability for smuggling of all goods has been introduced in Ukraine
Ukraine introduces criminal liability for smuggling of all goods. The State Customs Service and Bureau of Economic Security will deal with the issue.
From July 1, criminal liability for smuggling of all goods will be introduced, the European Business Association reported.
Law 5313-IX introduced criminal liability for commodity smuggling:
• worth from 7.57 to 15.14 million UAH – liability in the form of a fine from 170 to 425 thousand UAH;
• worth more than UAH 15.14 million – from a fine of UAH 850,000 to imprisonment for 11 years with confiscation of property.
For excise goods, the law entered into force on January 1, 2024. In particular, liability is provided for the smuggling of goods:
• worth from 1.136 to 2.271 million UAH – in the form of a fine from 340 thousand UAH to 6 years of imprisonment;
• worth more than UAH 2.271 million – from a fine of UAH 1.275 million to 12 years in prison with confiscation of property.
The law was adopted in the editorial office with some amendments insisted on by the business. The main achievement of EBA in the process of working on this initiative was the abolition of criminal liability for “unreliable declaration” (unintentional errors in declaration). Also, thanks to the efforts of the Association, the threshold values of the value of violations for the application of criminal liability were significantly increased.
The State Customs Service and the Bureau of Economic Security will be entrusted with the control function regarding the mentioned offenses.
