Kernel’s delisting procedure does not depend on the court’s victory against the minority shareholders


The court ruling that Kernel agroholding won against minority shareholders has no direct impact on the delisting procedure from the Warsaw Stock Exchange.

This was stated by the spokesman for the Polish Financial Supervision Authority, Jacek Barszczewski, Latifundist writes.

According to him, the court ruling concerns the proceedings in which the shareholders appealed the decision of the General Meeting of December 11, 2023, and not the proceedings to appeal the decision to delist, which is still pending in a court in Luxembourg.

“For this reason, the decision announced by the company today has no direct impact on the delisting procedure conducted by the Commission (currently suspended),” said Jacek Barszczewski.

Recall that Kernel recently won the first court case against minority shareholders.

Thus, on November 27, the District Court of Luxembourg issued a ruling according to which the claims of minority shareholders were declared inadmissible and, as a result, dismissed.
