Kernel’s delisting from the Warsaw Stock Exchange has been suspended: what is known

The procedure for the delisting of the agricultural holding Kernel from the Warsaw Stock Exchange remains blocked due to legal proceedings in Luxembourg.

The Polish Financial Supervision Authority (KNF) has suspended the delisting proceedings until the end of the legal proceedings in Luxembourg, reports the Polish publication Parkiet.

As a reminder, the decisions of the Kernel board of directors of April 13, 2023, including the decision to delist the company, are being appealed in Luxembourg.

“The proceedings for the delisting of Kernel, which are being conducted by the KNF, remain suspended, as the court in Luxembourg has not yet ruled on the case of invalidating the decisions of the board of directors of April 13, 2023, including the decision to delist,” said KNF spokesman Jacek Barszczewski.

It should be noted that due to the absence of a decision from the Luxembourg court, even the actual size of the share of Namsen, a company controlled by Andriy Verevsky, remains uncertain. If the additional issue of Kernel shares in 2023 was carried out legally, Namsen controls more than 95% of the company’s shares. If the court finds it invalid, this threshold will not be reached.

As previously reported by USM, Kernel increased its net profit in January-March by 2.2 times – to $89 million.
