SAP completed the investigation in Pivovarskyi’s case


The prosecutor’s office completed the pre-trial investigation in the case of the former Minister of Infrastructure of Ukraine and his former first deputy.

On August 8, the SAP prosecutor decided to complete the pre-trial investigation against the former Minister of Infrastructure of Ukraine and his then first deputy. This was reported by the press service of the Special Anti-Corruption Prosecutor’s Office (SAP). It will be recalled that the officials were suspected of abuse of power and official position.

According to the case materials, in 2015, Minister Andriy Pyvovarskyi, together with his first deputy, who was then the head of the Tariff Council of the Ukrainian State University, issued an order that allowed private companies to charge half of the rate of ship dues in the “Pivdennyi” port.

According to the investigation, they had no right to issue this order, because the water area of the “Pivdennyi” seaport is state property and is used by the USPA. Yes, the right to fees belongs exclusively to the state enterprise.

The law enforcement officers believe that, as a result of the adoption of the order on ship dues, the SE USPA suffered more than 49.63 million dollars in losses.

Sanctions on charges of expositors include imprisonment for a term of 3 to 6 years with deprivation of the right to hold certain positions or engage in certain activities for 3 years and a fine of 500 to 1,000 tax-free minimum incomes of citizens.

However, the ex-minister himself noted that the current legislation entrusts the resolution of issues related to the definition and change of the port dues collection procedure to the Ministry of Infrastructure.

At the same time, the order of the MIU, which changed the order of distribution of ship tax funds, was previously agreed upon by a number of ministries and departments. In particular, this issue was considered and supported at the Cabinet meeting.

In addition, according to Pivovarskyi, the issuance of the order was preceded by its discussion in the Tariff Council. The ministry’s document was approved by the Ministry of Justice, and therefore checked for compliance with current legislation. Only after that the order was registered and entered into force.

In the future, NABU detectives will reveal the results of the case to the defense.
